REZUMAT
Studiul nostru, folosind în principal metoda istorică, va examina câteva modele familiale netradiţionale, consacrate tacit sau explicit în istoria dreptului privat european, din antichitatea romană şi până în epoca modernă. Vor fi luate în calcul deviaţiile de la modelul tradiţional al familiei compuse din soţ şi soţie, priviţi drept cuplu căsătorit cu formalităţile şi ceremonialul prevăzut de lege, împreună cu copiii legitimi ai acestora. În final, vor fi examinate şi modelele familiale netradiţionale prevăzute explicit sau reglementate implicit de dreptul pozitiv din România, fără însă a ne limita doar la dreptul privat.

LES AVATARS NON-TRADITIONNELS DES FAMILLES EN L’HISTOIRE DU DROIT PRIVE EUROPÉEN
RÉSUMÉ
Cette étude utilise principalement l’approche historique pour examiner quelques modèles familiaux non traditionnels, implicitement ou explicitement prescrits dans l’histoire du droit privé européen, de l’Antiquité romaine à l’époque moderne. Nous prendrons en compte les écarts par rapport au modèle familial traditionnel composé d’un mari et d’une femme, considérés comme un couple marié avec toutes les formes et cérémonies prévues par la loi, ainsi que leurs enfants légitimes. Enfin, nous examinerons également les modèles familiaux non traditionnels explicitement prescrits ou implicitement réglementés par le droit roumain actuel, sans nous limiter seulement au droit privé.

NON-TRADITIONAL FAMILY AVATARS IN THE HISTORY OF EUROPEAN PRIVATE LAW
ABSTRACT
This study uses mainly the historical approach to examine some non-traditional family models, implicitly or explicitly prescribed in the history of European private law, from the Roman antiquity to the modern times. We will take into account deviations from the traditional family model comprising a husband and wife, seen as a married couple with all the forms and ceremonies provided by law, together with their legitimate children. Finally, we will also examine non-traditional family models explicitly prescribed or implicitly regulated by current Romanian law, without limiting ourselves only to private law.
