ANALYSIS OF THE NEW LEGAL REGIME OF THE PATRIA POTESTAS IN SPAIN AFTER THE REFORMS OPERATED BY THE LAWS PASSED ON 2^nd AND 28^th OF JULY 2015

Resumen
El presente trabajo contiene un análisis crítico, con propuestas de solución, a los problemas que plantean, de las figuras que integran actualmente el régimen jurídico de la patria potestad
vigente en España tras las reformas legales de los últimos años del Código civil en esta materia. Además del análisis legislativo de las relaciones personales y patrimoniales entre los padres y sus
hijos, también se estudia la doctrina y se aporta la jurisprudencia más reciente interpretando los temas más controvertidos de estas relaciones jurídicas. Este sistema legal que se estudia, está
presidido por el principio del interés superior del menor que se establece en los tratados y convenciones internacionales sobre los menores de edad y las personas discapacitadas.

Abstract

The present work contains a critical analysis, with proposals of solution, to the problems that they pose, of the figures that integrate now the juridical regime of the patria potestas in force in Spain after the legal reforms of the last years of the Civil Code in this matter. In addition to the legislative analysis of personal and property relations between parents and their children, the doctrine is also studied and the most recent jurisprudence is provided interpreting the most controversial issues of these legal relationships. This legal system is studied, is chaired by the principle of the best interests of the child that is established in international treaties and conventions on minors and disabled people.
