REZUMAT
Codul civil a adus modificări importante în ceea ce priveşte instituţia adopţiei. Doar adopţia cu efecte depline este reglementată. Cu privire la efectele adopţiei, mai ales în ceea ce priveşte ipoteza în care persoana adoptată are descendenţi anterior adopţiei, pot fi identificate situaţii atipice, pe care legislaţia în vigoare nu le tranşează într-un mod elocvent. În prezentul studiu, sunt analizate efectele adopţiei din această perspectivă, prin raportare la legislaţia internă şi reglementările internaţionale în domeniu.

CONSIDÉRATIONS SUR L’ADOPTION PLÉNIÈRE DANS LA LÉGISLATION ROUMAINE SI LA PERSONNE ADOPTÉ A DES DESCENDANTS BIOLOGIQUES
RÉSUMÉ
Le Code civil a apporté des changements importants à l’institution de l’adoption. Seule l’adoption plénière est règlementée dans cette loi. Concernant les effets de l’adoption, notamment en ce qui concerne l’hypothèse où l’adopté a des descendants avant l’adoption, des situations atypiques peuvent être identifiées, que la loi en vigueur ne résout pas de manière éloquente. Dans la présente étude, les effets de l’adoption sont analysés dans cette perspective, par référence à la législation nationale et aux réglementations internationales en la matière.

REFLECTIONS ON THE FULL EFFECT ADOPTION IN THE ROMANIAN LEGISLATION FOR THE CASE IN WHICH THE ADOPTED PERSON HAS BIOLOGICAL DESCENDANTS
ABSTRACT
The Romanian Civil Code has brought significant changes regarding the adoption procedure. Only the full effect adoption is regulated in the current civil legislation. Regarding its effects, especially in the particular case in which the adopted person has descendants prior to his/hers adoption, certain uncommon situations can be identified, situations that are not fully taken into account in the current legislation. In this study, the effects of the adoption are analysed from this perspective, taking into account the national legislation and the relevant international regulations.
