REZUMAT
Este important ca omul să se pregătească din timp pentru posibilitatea de a-şi pierde în viitor capacitatea deplină de exerciţiu. În unele ţări ale Uniunii Europeană există mijloace
juridice eficiente, respectiv îndrumarea prealabilă ‒ AD (advance directive) – şi împuternicirea permanentă ‒ CPA (continuing power of attorney) – care pot fi utilizate pentru a garanta că individul ‒ în cazul survenirii incapacităţii sale de a se îngriji de persoana sa ori de a-şi administra bunurile ‒ va putea beneficia în viitor de aceste forme speciale de protecţie. Am prezentat AD şi CPA ca posibile soluţii juridice şi medicale care ar putea fi aplicate exhaustiv şi în România, indiferent de apariţia acută a oricărei probleme de sănătate. Am descris câteva repere de drept comparat în corespondenţă cu legislaţia română, care ar putea deschide o nouă perspectivă de extindere a cadrului legal şi implementarea posibilelor soluţii de urmat.

Il est important que la personne se prépare à l’avance à la possibilité de perdre sa pleine capacité d’exercice à l’avenir. Dans certains pays de l’Union européenne, il existe des moyens
juridiques efficaces, c’est-à-dire la directive anticipée ‒ AD (advance directive) – et la procuration permanente ‒ CPA (continuing power of attorney) – qui peuvent être utilisés pour garantir que la personne ‒ en cas d’incapacité à prendre soin de lui-même ou à gérer son patrimoine ‒ pourra bénéficier à l’avenir de ces protections particulières. Nous avons présenté AD et CPA comme des solutions juridiques et médicales possibles qui pourraient être appliquées de manière exhaustive en Roumanie, indépendamment de la survenue aiguë de tout problème de santé. J’ai décrit quelques repères de droit comparé en correspondance avec la législation roumaine, qui pourraient ouvrir une nouvelle perspective d’élargissement du cadre juridique et de mise en oeuvre des solutions possibles à suivre.

CONSIDERATIONS REGARDING SOME SITUATIONS OF VULNERABILITY OF THE ADULT
ABSTRACT
It is important that the person prepares ahead of time for the possibility of losing his full exercise capacity in the future. In some countries of the European Union there are effective legal means, i.e. advance directive ‒ AD – and continuing power of attorney ‒ CPA – that can be used to guarantee that the person ‒ in the event of his inability to take care of himself or manage his assets ‒ will be able to benefit from these special forms of protection in the future. We presented AD and CPA as possible legal and medical solutions that could be applied exhaustively in Romania, regardless of the acute appearance of any health problem. The first step in this regard is the creation of the appropriate legal framework and the implementation of possible solutions. I have described some benchmarks of comparative law in correspondence with the Romanian legislation, which could open a new perspective of expanding the legal framework and the implementation of possible solutions to follow.
