SUR LA PRÉDICTIBILITÉ DANS LA COOPÉRATION CONSOLIDÉE. DE ROME III AUX RÉGIMES MATRIMONIAUX ET AUX PARTENARIATS ENREGISTRÉS
RÉSUMÉ
Les trois formes consolidées dans le domaine des relations familiales datent des années 2010 et 2016. Si Rome III (2010) est dédié aux conflits de lois, les Règlements «régimes matrimoniaux» et «partenariats enregistrés» (2016) approchent la loi applicable et aussi la compétence juridictionnelle et l’efficacité des jugements étrangers. La prédictibilité est l’exigence déclarée dans le préambule de chaque Règlement, et les instruments de son application concrète sont définis en 2010 et cristallisés en 2016. Il y a aussi des notes communes et des éléments de différence, le législateur entendant à s’adapter au caractère spécifique des institutions (mariage, partenariat civil), pour identifier les solutions optimales, sur les deux paliers examinés (loi applicable, juridiction internationale). Les aspects les plus intéressants du matériel de la prédictibilité sont associés à l’autonomie de volonté at aux facteurs de liaison, ayant le rôle de garantir et de consolider la prédictibilité dans le circuit juridique transfrontalier. L’analyse vise les conflits de loi et la juridiction, dans chacune des matières présentes en formes consolidées: des procédures matrimoniales internationales, des régimes matrimoniaux, des effets patrimoniaux des partenariats enregistrés.

ABOUT PREDICTABILITY IN THE CONSOLIDATED COOPERATION. FROM ROME III TO MATRIMONIAL REGIMES AND REGISTERED PARTNERSHIPS
ABSTRACT
Those three consolidated forms in the field of family relationships date back to the years 2010 and 2016. If Rome III (2010) is dedicated to the conflicts of laws, the Regulations “matrimonial regimes” and “registered partnerships” (2016) approach both the applicable law, and the jurisdiction and the efficiency of foreign judgements. Predictability is the exigence declared in the recitals of each Regulation, and the tools of its materialization are outlined in 2010 and stabilized in 2016. There are common notes and difference elements, as the legislator understands to adapt to the specific nature of the institutions (marriage, civil partnership), in order to identify optimal solutions, on both examined pillars (applicable law, international jurisdiction). The most interesting aspects of the predictability tool are associated to the autonomy of will and to the connecting factors, whose part is to ensure and consolidate the predictability in the cross-border legal circuit. The analysis aims at the conflicts of law and jurisdiction, in each matter present in the consolidated forms: international matrimonial procedures, matrimonial regimes, patrimonial effects of the registered partnerships.
